Appellant was convicted by a jury of credit card abuse. V.T.C.A. Penal Code, ? 32.31. Punishment was assessed at eight (8) years confinement in the Texas Department of Corrections and a $4,000 fine. On direct appeal, the Fort Worth Court of Appeals reversed the conviction and ordered a judgment of acquittal. Chambers v. State, delivered October 27, 1983, No. 2-83-198-CR. Both the District Attorneys and State Prosecuting Attorneys Petitions for Discretionary Review were refused by this Court on April 4, 1984. On December 3, 1984, we granted leave to file a motion for rehearing by the State Prosecuting Attorney to consider the correctness of the holding by the court of appeals. The motion for rehearing will be granted.
