Description

Action for a declaratory judgment determining the validity of a county ordinance. The plaintiffs are licensed retailers of
beer in the Town of Burlington, Racine County. The ordinance prohibits the sale or gift of beer to any person under the age
of twenty-one years unless accompanied by parent or guardian, and prohibits the purchase of beer by any person under the age
of twenty-one years. Violation is made punishable by fine, and by imprisonment in the county jail in default in payment of
the fine. Enforcement is placed in the hands of the sheriff. From a summary judgment declaring the ordinance invalid, and enjoining its enforcement against the plaintiffs, defendant
appeals.
